I have a trouble here

I've encountered a very troublesome thing here, and I'm asking people here on the forum to give me their opinions.
I bought this graphics card Suprim X RTX 3070 TI for two years. Unfortunately, I played it for 18 months in two years,Then something went wrong, so I sent it back to the computer shop and let them send to MSI factory warranty.
After waiting for two months, MSI agreed to exchange it for me with a Suprim X RTX 3080 LHR, Now this Suprim X RTX 3080 LHR has only been played for 5 months and it has problems again,I sent it back to computer shop and make second time warranty to send MSI factoy.
Because the computer shop owner broke my graphics card and refused to admit it,Because of this problem, my graphics card cannot be sent to the warranty store and return.
It doesn't matter. I have to pay for the repairs myself, I was later told that this graphics card was refurbished card one !
Is that MSI fatory will doing like this ? send back warranty and exchange refurbished one graphic card to me ?

I do not see any damage that would be a problem

The first four pictures got crash and heatsink got some concave and convex that is the MSI it was already there when it was sent to me.
And the last one pictures damage is from computer shop make it and they do not admit !
I once tried to write to MSI factory, However, their customer service response will only tell you to go back to where you buy from the graphic card merchant .

Do all MSI dealer help customer like this ?
I bought a new one graphics card two years and play 18 months only is gonna be problem occurs, send warranty exchange the refurbished graphics card for me.

That is pretty normal it amazes me that people believe that if their 2-year-old Item stops working they will get a brand new one under warranty, not one the same age that has been fully repaired
