If that's the dust on the heatsink, [the photos are not on perfect focus]
then seems used, talk to the place of purchase.

On the 1st photo, if you mean the sealing, they comes not really sealed and that's not a criteria if its new or not.

Thanks Svet, I decide to keep it. lil dust is not big issue but it was there when I open the box. I talk to Microless, If I had any issue I'll send it back.

Got it, you can use the dust blower to clean it, but its still good idea to complain to your reseller and to notify it.

i agree with Svet that its better to complain to the seller so they know as its quite possible they may give a part refund on it as it was obviously used not brand new (done that before myself as it was not as described)

Yes, they could be sent the wrong card due some error,
say 2nd hand card, or some different card who has some kind of malfunction on it.
Best to confirm at least with the seller that the card they sent you is in fully working state.

Thanks for the help Svet, badboy2k. The card is amazing.
The only 1 thing I can't figure out is choppy unsmooth game play. I tried installing Nvidia new drivers turn off background app. Still same slight choppiness.

Can you tell more details about the choppy unsmooth game play?
Which game is this? Does it happens everywhere on only in specified game?

Star wars battlefront 2 + jedi. It is happening in all games tbh.
Can windows 10 driver cause stutter ?
If there is conflicts it will cause stutter so I let windows update all drivers.

What display you are using, at what Hz, do you have vsync enabled or gsync?

Right now I'm working on Alienware Aw2518f 240hz.
V.sync is off/ G.sync is On only on full screen mode.
bios setting hyper th. Off. Intel C state, EIST off only intel speed shift is on.

Try record the GPU usage, then check for anomalies.
Try lower in-game settings, try latest Nvidia drivers

With GPU-Z enable log to file, then check the log file
or with Afterburner check the trend history
