X870 CMOS battery stuck

I need to take out the cmos battery but can't get the little black shield out from behind the release tab.

Regulations for California Regarding Button Cell Batteries! that is what that is all about.

the Battery Cell has to be made to not be Easily Removed by an end user or can not be sold in California as any button Cell has to be made to not be easily Removed so thank the Regulators in California USA for that one of forcing anyone who wants to sell there to have there products match that Regulation they did.
